(“Mototrax”) disseminates this privacy policy (“Privacy Policy”) to communicate to its customers its policies and practices pertaining to the collection, use and disclosure of information obtained on this Website (“the Website”). This Privacy Policy does not apply to any information about you that Mototrax may obtain by other, non-private means, for example as part of a warranty registration. You should contact Mototrax to obtain further information on its policies and practices in relation to the collection, use and disclosure of such information.

By using the Website, you consent to the collection, use and disclosure of your information as described in this Privacy Policy. This policy reflects Mototrax’s current business practices, and is subject to changes and updates. In the event of any change or update, a revised policy will be posted on the Website, with the date of the most recent change or update printed at the bottom of the page. It is important that you check the Website periodically to remain informed of any changes or updates to this Privacy Policy. If Mototrax intends to disclose personal information collected from users of the Website to third-parties in a manner that is not already outlined in this Privacy Policy, Mototrax will first notify the affected users by e-mail, and provide an opportunity for them to decline any such use or disclosure. Your use of the Website constitutes your consent to the collection, use and disclosure of your information, including personal information, by Mototrax under the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, or any modifications to this Privacy Policy, you are not authorized to use, nor should you use, any portion of the Website that requires you to provide information about yourself.

  1. The Information Mototrax Collects.

You may access certain areas of the Website without providing any information to Mototrax. Mototrax may collect, however, non-personal information about you, such as is described in Section 4, titled “Cookies.”

In order to become a registered user of the Website, you will need to provide information as part of the registration process, including your name, address, telephone number, birthdate, and e-mail address. If you choose to purchase any products or use any services offered on the Website, MotoTrax may also ask that you provide certain financial information (e.g., credit or debit card number) for the purposes of credit checks, and arranging payment and processing of any order (see Section 5, second paragraph).

From-time-to-time, Mototrax may include features on the Website, such as information requests, surveys and other requests, which ask you to provide personal information, such as your name, telephone number, e-mail address or mailing address. Any information you may provide will be used by Mototrax to allow you to participate in the particular feature being offered. Mototrax may also retain any information you provide in order to send you information about Mototrax’s products and services that may be of interest to you. Mototrax will provide you with the opportunity to opt-out of receiving such communications. See Section 3, “Receiving Communications; Opting-Out.”

Mototrax may offer sweepstakes, games and other contests on the Website, either solely or in conjunction with one or more third-parties. You may be asked to provide your name, mailing address and/or e-mail address and date of birth, as well as certain other information on an optional basis (e.g., your gender, annual household income or other types of vehicles that you have purchased), in order to participate in offered sweepstakes or contests. This information may also be used by Mototrax or its third-party partner to send you information about Mototrax’s or the third-party partner’s products and services. Such information may come in the form of an e-mail or surface mail communication or via a telephone call. Mototrax will provide you with an opportunity to opt-out of receiving such communications from Mototrax each time you receive such a communication, as described in Section 3 below, titled “Receiving Communications; Opting-Out.” Mototrax does not control and cannot be held responsible for the privacy policies or practices of its third-party partners. If you no longer wish to receive such communications from any third-party partner of Mototrax in a sweepstakes or other contest that you may enter, you will need to contact that third-party partner directly and opt-out as provided in the privacy policy of that third-party partner.

Third-parties may offer products and services on the Website and collect information about you by requesting certain information necessary to provide a particular product or service (including, for example, insurance coverage for your Mototrax products). Mototrax may also obtain certain information about its users from third-party customer research groups, which Mototrax may use to learn more about its customers. Mototrax does not control the policies and practices of third-parties in relation to the use and disclosure of any information about users collected by third-parties on the Website or in market research programs conducted by third-parties, and any use or disclosure of such information by third-parties is beyond the control of MotoTrax and is not governed by this Privacy Policy.

  1. Receiving Communications; Opting-Out.

Mototrax provides you with the opportunity to receive information by e-mail, surface mail or telephone calls from Mototrax, or third-parties which may be of interest to you, including information relating to new products and services offered on the Website by MotoTrax, or other third-parties.

If you do not want to receive any information via e-mail, surface mail or telephone calls, you may opt-out of further communications provided by Mototrax at any time by: (i) sending Mototrax an e-mail addressed to mototraxsnow@gmail.com; or (ii) writing to Mototrax at Mototrax, Inc. 3808 N Sullivan Rd Bldg 100 Ste D, Spokane Valley, Washington, 99216, Attention: Webmaster. Please note that Mototrax can only comply with requests relating to e-mail, surface mail or telephone communications provided by Mototrax. If you no longer wish to receive further information via e-mail, surface mail or telephone from any third-party, you will need to contact that third-party directly to opt-out of further communications.

  1. Cookies.

Mototrax uses cookies and similar devices on the Website to track orders you may make in purchasing products on the Website, to facilitate site-navigation and to customize the information that appears on the Website. Mototrax also uses cookies and similar devices to collect non-personal information about users of the Website, such as a user’s IP address, the type of web browser and operating system being used and/or the pages of the website a user visits. Mototrax collects this information in order to process online purchases, to monitor usage of the Website and to improve aspects of the Website, or to allow a third-party to conduct such activities on MotoTrax’s behalf.

 

Most browsers accept cookies automatically but can be configured not to do so or to indicate when a cookie is being sent. We recommend that you do not disable your browser from accepting cookies, as it will prevent you from moving freely from page to page and from taking advantage of all of the features of the Website, including accessing secure areas of the Website and purchasing Mototrax products on the Website.

  2. Mototrax may disclose your personal and non-personal information to third-parties who provide services on or to the Website. Mototrax cannot control the policies or practices of third-parties to which Mototrax discloses information about Mototrax’s users, and any use or disclosure of any information by third-parties cannot be and is not governed by this Privacy Policy. Third-parties may also use or disclose information you provide on any website which is linked to the Website, or which third-parties may collect using cookies or similar devices on such website, as described in Section 6, titled “Links.”
  3.     Mototrax may disclose certain financial and other information you provide to Mototrax to third-parties offering products and services for sale on the Website, as well as to third-parties that provide credit reporting, payment or order fulfillment services. Reasons for doing so include verifying your information, approving your registration as a user of the Website, authenticating your payments and processing your orders.
  4. You may submit information about new user clubs related to Mototrax’s products or stories and photographs for inclusion in Mototrax’s online scrapbook. You should not submit to Mototrax any information that you consider sensitive and to be protected from viewing or use by others, as any information you submit to Mototrax for posting on the Website may be available to the public and may be collected and used by persons other than Mototrax.. MotoTrax does not regularly monitor these areas of the Website, and you submit such information to Mototrax for posting at your own risk.
  5.     Mototrax may disclose your information if we believe in good faith that such disclosure is necessary to comply with applicable law, a subpoena or other legal process. Mototrax may also disclose such information as is necessary to identify, contact or bring legal action against a person or entity who may be violating any agreement to which such person or entity and Mototrax are parties, or who may be causing injury to, or interference with, other users of the Website, or third-parties who may be harmed by such activities. In the event that Mototrax, or all or part of its assets, are acquired by a third-party, user information may be included in the transferred assets.
  6. Links.

The Website contain links to other third-party websites, as well as club and fan websites related to Mototrax’s products and services. Mototrax has no control over the content, policies or actions of those websites, even if those websites offer you products or services because you are a registered user of the Website, or have purchased products or used services offered by Mototrax. The use of any information you may provide to third-parties on other websites, or which such parties may otherwise collect on other websites, cannot be and is not governed by this Privacy Policy. You should carefully review the privacy policies of any third-party websites and contact the operators of those websites if you have any questions about their use of your information. Mototrax cannot be held responsible for any third-party, or its affiliates or agents, failing to use your information in accordance with this Privacy Policy or such third-party’s privacy policy, or for any contractual or other legal obligations to which such third-party, its affiliates or agents, may be subject.

  1. Security.

Mototrax has implemented security measures to protect personal information provided by you against access and use by persons not authorized to do so. Mototrax also uses commercially-reasonable efforts to establish secure connections with your web browser for any transactions conducted online using credit or debit cards or electronic funds transfers from bank accounts. No data transmission over the Internet can be ensured to be completely secure, and any information disclosed online can potentially be collected and used by parties other than the intended recipient.

  1. Changes and Access to Personal Information.

You may ask Mototrax to correct, update or delete information you have provided to Mototrax by: (i) sending Mototrax an e-mail at mototraxsnow@gmail.com; or (ii) writing to Mototrax at Mototrax, Inc. 3808 N Sullivan Rd Bldg 100 Ste D, Spokane Valley, Washington, 99216, Attention: Webmaster. You should be sure to provide Mototrax with any updates and changes to your personal information, including your e-mail address, as they occur. Unless otherwise required by law, Mototrax will retain in its archives, and may use, any communications sent by you and/or any information you have provided to Mototrax even after you cease to be a registered user of the Website, or to otherwise use the Website, unless you direct Mototrax in writing not to do so, and only provided Mototrax actually receives those instructions.
